What is the E1/E2 visa?

The E1 visa is a visa intended for foreign citizens wishing to undertake an international business activity from the United States. In order to obtain it, it is mandatory that more than 50% of the commercial exchanges take place between the visa owner's country and the United States, and that the volume of these transactions is "considerable": they must be continuous and significant.

The E2 visa is for entrepreneurs who want to set up or run a business in which they invest substantial capital. The conditions for obtaining this visa are more numerous than for the E1 visa:

*    The investment must be active (an investment in land only is not considered active but passive);
*    The investment must come from own funds and be consequent (being able to ensure the launching     and development of the activity);
*    Be a member of the management;
*    Prove that the activity is profitable
*    Own at least 50% of the shares ;
*    The company must participate in the local economy (e.g. through job creation);

 

E1 and E2 visas are issued for a period of 5 years and are renewable indefinitely as long as the activity continues. They also allow the spouse to follow the visa holder to the United States and obtain a work permit (different from the green card) or a study permit (F1 visa).

 
How to obtain the E1/E2 visa?

There are several steps to follow in order to obtain an E1 or E2 visa:

    Fill out the DS-160 form;
*    Create an account on the website of the American Embassy in your country in order to pay the visa application fees;
*    Create a file to be sent by email to the embassy containing the necessary documents (see the list of E1 and E2 documents);
*    The U.S. Embassy will then contact you to schedule an interview with an American agent to explain your project;
*    If your application is accepted, the visa will be sent to you within the next 3 to 5 business days.
